INTRODUCTION
These terms and conditions of use expressly regulate the relationships established between Adaptative Learning, S.L. (hereinafter Adaptative) and any user (hereinafter the User or Users) who downloads and uses the Snackson Application (hereinafter the Application or Snackson) or accesses its web services.
The relationship established between the User and Adaptative is understood as part of a service commissioned by the organization to which the User belongs (hereinafter, the Organization) in the manner described below.
By installing Snackson or accessing its web services, the User accepts these terms and conditions of use.
1. PURPOSE
Snackson is a microlearning platform, owned by Adaptative Learning, S.L., which offers a service based on the distribution of small content or microcontent organized in temporary microcourses that seek the acquisition of knowledge by the User. The User receives the content and is rewarded with points for viewing it or for correctly answering the questions posed in the microcourse.
Adaptative reserves the right to implement new functionalities or services, free or paid. In any case, Users will be previously notified at the time of the implementation of the new functionalities or services.
Snackson can be used on devices with Android and iOS systems (in versions from the last two years onwards), and through its web version accessible from modern browsers. Compatibility is subject to periodic updates of operating systems and browsers.
2. LICENSE OF USE
Adaptative offers a revocable, free, non-exclusive, and international license to use the Snackson application within the limits established by these terms and conditions.
Downloading Snackson is free for the User for personal and non-commercial use. Adaptative reserves the right to modify or disable Snackson at any time and for any reason, with reasonable prior notice whenever possible.
3. ACCESS AND REGISTRATION
To be a User of Snackson, it is essential to meet the following requirements:
- Be of legal age, unless expressly authorized by the Organization and with the consent of the holders of parental authority or guardianship.
- Be part of an organization, company, government, or other legal entity that has a current commercial relationship with Snackson.
The User undertakes to verify and keep updated all data about their identity and legitimacy provided to Adaptative in their registration in Snackson as they are truthful, accurate, and complete. In the event that Adaptative considers that there are well-founded reasons to doubt their veracity, accuracy, and integrity, Adaptative will deny the User access to and present or future use of Snackson or any of its contents and/or services.
When accessing Snackson for the first time, the User can: (1) receive access composed of an email and password or (2) receive a temporary access code via email. The access key is strictly confidential, personal, and non-transferable. The User agrees not to disclose the data related to their account or make them accessible to third parties. The User will be solely responsible in case of use of said data by third parties, including the statements made in Snackson, or any other action carried out through the use of the username and/or password.
The User agrees to use all necessary measures for the protection of their access key, specifically the User agrees to:
- Choose a secure password, with a combination of uppercase and lowercase letters, numbers, and symbols, or use a password manager;
- Not reveal their password to any other person;
- Change the password periodically;
- Not leave their user account active on mobile devices that do not belong to them or protect access to their device with verification measures;
- Activate, when possible, two-factor authentication.
Adaptative cannot guarantee the identity of registered Users, therefore, it will not be responsible for the use of the identity of a registered User by unregistered third parties. The User is obliged to immediately inform Adaptative of the theft, disclosure, or loss of their username or password, by communicating it to hello@snackson.com
4. PROFILE
Once registration is completed, the User will be able to access their profile, but will not be able to edit or modify it, since the profile data is determined by the course manager within the Organization.
Profile data, including name, surname, email, department, or any other identifying information, are established and controlled exclusively by the Organization. The User will only be able to change or restore their password if they have accessed using the email and password method, following the established procedures.
The Organization is solely responsible for the accuracy and updating of profile data, and the User must contact it for any modification required.
5. OPERATION OF THE APPLICATION
The User must download the Application or access the web version. The navigation language of the interface and the contents will depend on the configuration established by the Organization and the training materials it has developed or incorporated. Adaptative is not responsible for the language in which the content provided by the Organization or third parties is produced.
Once registered in the Application, the User will have access to the microcourses and will be able to participate in the learning dynamics.
The User can participate in several microcourses in parallel. The User will receive notifications through the Application each time a new microcontent (learning objects) arrives. These objects can be informative (text, image, video) or evaluative (questions, interactive exercises, case studies, etc.).
The Application has a notification system that alerts the User if there is new content or if they have won a prize or a badge.
Badges constitute a distinctive emblem awarded by Snackson according to a series of score criteria that the User achieves.
The Application in turn keeps track of viewed and favorited content, as well as the User’s learning patterns, which can be used to personalize their learning experience.
6. USER RESPONSIBILITIES
The User is fully responsible for the access and correct use of Snackson subject to current legality, whether national or international, as well as to the principles of good faith, morality, good customs, and public order. The User is responsible for having the necessary services and equipment for browsing the Internet and accessing Snackson.
Users will refrain from using the services and contents of Snackson for illicit purposes and effects that are harmful to the rights and interests of third parties, or that in any way may damage, disable, affect, or deteriorate Snackson, its contents, and its services. Likewise, it is prohibited to prevent the normal use or enjoyment of Snackson by other Users.
The User agrees to maintain appropriate and respectful behavior towards other Users. Therefore, in an expository but not limiting way, they agree not to behave in a violent, disrespectful, racist, discriminatory, harassing, intimidating, unhygienic manner, etc., responding personally to any damage or harm caused to other Users derived from their inappropriate conduct.
In general, the User agrees, in an illustrative and not exhaustive manner, to:
- Not use the application for illegal or unauthorized purposes;
- Not host, store, disclose, publish, distribute, or share any content that may constitute an illegitimate intrusion or violation in any form of the fundamental rights to honor, image, and personal and family privacy of third parties and, especially, of minors;
- Not publish in those spaces of Snackson specially enabled, whether part of their own profile or another User’s, any comment or information that is illegal, racist, xenophobic, obscene, pornographic, abusive, defamatory, misleading, fraudulent, or in any way contrary to morality or public order;
- Not alter or modify, totally or partially, Snackson, evading, deactivating, or manipulating in any other way its functions or services;
- Not infringe industrial and intellectual property rights or the regulatory rules of personal data protection;
- Not use Snackson to insult, defame, intimidate, violate self-image, or harass other Users;
- Not access other Users’ email accounts;
- Not introduce computer viruses, defective files, or any other computer program that may cause damage or alterations to the contents or systems of Snackson or third parties;
- Not send emails with a massive and/or repetitive character to a plurality of people, nor send email addresses of third parties;
- Not carry out advertising actions of goods or services without the prior consent of Snackson.
7. SNACKSON’S RESPONSIBILITIES
The User declares to accept and understand that the services are offered “as is”, “as available”, and “according to availability”.
In this sense, Adaptative does not guarantee or assume responsibility for:
- The punctuality, uninterruption, security, and absence of error of Snackson services;
- The accuracy, reliability, or security of the contents offered through Snackson;
- The correction of possible errors present in the Snackson software;
- The possibility that damage does not occur in some computer system, the security and durability of its data, or any other damage that may be caused by the access or use of Snackson or any content hosted in the application;
- That the storage space is unlimited or that it can attend to any type of demand;
- The transmissions, of any type of information, communicated or content, are provided to the User at the desired time, nor for the emission or reception of these.
In case of occasional interruptions in Snackson or if Adaptative needed to make maintenance stops, Snackson will not have the obligation to compensate the User in any way, it being understood that these are caused by external agents of an exceptional nature that Adaptative cannot control. However, Adaptative commits to inform with sufficient notice of scheduled stops for maintenance.
8. INTELLECTUAL PROPERTY AND RESPONSIBILITY FOR CONTENT
Snackson can host content from Adaptative as well as other content developed and provided by the Organization or by third parties. Adaptative does not exercise editorial control over the content developed by the Organization or third parties, nor is it responsible for the quality, accuracy, reliability, correction, or morality of the same, nor for the language in which they are produced.
It will be the sole responsibility of the Organization to obtain the rights to the content for use in Snackson, and Adaptative cannot be considered responsible in any case for the unauthorized use of said content.
Adaptative is therefore the owner or licensee of all intellectual and industrial property rights over all content accessible through Snackson. The intellectual and Industrial property rights of Snackson, as well as: texts, images, graphic design, navigation structure, information, and content contained therein, unless otherwise indicated, are owned by Adaptative, to whom corresponds the exercise of the exploitation rights of the same and, especially, the rights of reproduction, distribution, public communication, and transformation, in accordance with Spanish and European legislation on intellectual and industrial property rights.
Access to Snackson does not imply waiver, transmission, license, or total or partial assignment of intellectual or industrial property rights by Adaptative.
Likewise, Adaptative is not obliged to supervise or control the content published by the User through Snackson, nor can it be considered responsible as long as it does not have effective knowledge that the activity or stored information is illegal or that it harms goods or rights of a third party. However, Adaptative has reporting and moderation mechanisms to remove inappropriate content.
9. NOTIFICATIONS AND COMMERCIAL COMMUNICATIONS
As part of the services, the User may receive push notifications on their mobile device or emails with a variable frequency, as determined by the Organization. If they do not want to receive them, it will be the User’s responsibility to deactivate this function from the settings or preferences menu present on their terminal or request the cancellation of electronic communications following the instructions included in each communication.
Similarly, the User declares to be informed that the Organization may use their email account to provide them with information regarding Snackson and the dynamics of the service.
Likewise, Adaptative may send instructions on the process of recovery or modification of the access key to their email.
In case Adaptative wishes to send its own commercial communications or those of third parties to Users, it will previously obtain express and specific consent, always offering the possibility of opposing this treatment in a simple and free way.
10. SERVICE CANCELLATION
The Organization may cancel the User’s account when it deems appropriate according to the specific conditions established between the User and the Organization.
The User cannot cancel their account by themselves, since it is the Organization that has registered them and who manages their access to Snackson.
If the User wishes to cancel, they must request it directly from the Organization, which is responsible for user management. In case the User no longer agrees with these Terms and Conditions or wishes to no longer be a user of Snackson, in addition to uninstalling the application, they must formally contact the Organization to request the cancellation of their account.
The User can request information from Snackson, through the address info@snackson.com, about who is the responsible person or contact person within the Organization to process these requests.
Adaptative may temporarily deactivate or permanently eliminate, without prior notice and immediately, the User’s account when:
- These Terms and Conditions are violated;
- The User poses a threat to the integrity of Snackson or to any of its Users.
11. PRIVACY POLICY AND DATA PROTECTION
11.1 Legal basis and purposes of processing
In accordance with Regulation (EU) 2016/679 General Data Protection (GDPR) and Organic Law 3/2018, of December 5, on Personal Data Protection and guarantee of digital rights (LOPDGDD), Adaptative informs the Users of Snackson about the Privacy and Data Protection Policy that will apply in the processing of personal data that the User provides through access to Snackson.
The User, by providing Adaptative with their personal data through any section of Snackson, consents to it being able to process that data in the terms of this Privacy and Data Protection Policy clause.
Adaptative will process the User’s personal data for the following purposes:
- Manage their registration and access to the platform.
- Provide the training services contracted by the Organization.
- Analyze the use of the platform to improve the user experience and content.
- Develop learning profiles to personalize training, provided that the User has given their express consent or the Organization acts as the controller of this processing.
- Send communications related to the service.
- Address queries, complaints, or incidents.
The legal basis for the processing of their data is:
- The execution of the contract between Adaptative and the Organization to which they belong.
- The User’s consent for specific processing.
- The legitimate interest of Adaptative for the improvement of its services.
- Compliance with legal obligations.
11.2 Categories of data and origin
The personal data that Adaptative may process include:
- Identifying data: name, surname, email address.
- Professional data: company or organization, department, position.
- Usage data: actions performed on the platform, progress in courses, scores, etc.
- Device data: IP address, browser type, operating system, etc.
This data may come from:
- Directly from the User.
- From the Organization to which they belong.
- From browsing and using the platform.
11.3 Data communications and international transfers
The User’s personal data may be communicated to:
- The Organization to which they belong, as part of the follow-up reports and training analytics.
- Technology service providers that act as data processors.
- Competent authorities, when there is a legal obligation.
Some service providers of Adaptative may be located in countries outside the European Economic Area. In these cases, Adaptative guarantees that adequate guarantees are adopted to protect personal data through:
- Adequacy decisions by the European Commission.
- Standard contractual clauses.
- Binding corporate rules.
- Approved certification mechanisms.
11.4 Retention period
Personal data will be kept for the time necessary to fulfill the purposes for which they were collected and as long as the relationship with the Organization is maintained. Subsequently, they will be duly blocked during the limitation periods of possible legal responsibilities.
11.5 User rights
The User can exercise the following rights in relation to their personal data:
- Access: know what personal data is being processed.
- Rectification: modify inaccurate or incomplete data.
- Deletion: request the elimination of data.
- Limitation: request the restriction of data processing.
- Portability: receive the data in a structured format and transmit it to another controller.
- Opposition: oppose the processing of data.
- Not be subject to automated individual decisions, including profiling.
- Withdraw consent at any time.
To exercise these rights, the User must primarily contact the Organization, which is responsible for the processing of their data as a client that has contracted the services of Snackson. However, the User can also contact Adaptative in writing at rgpd@snackson.com, attaching a copy of their identity document or equivalent document.
If the User does not know who is the responsible person or contact person within the Organization, they can request this information from Adaptative through the email info@snackson.com.
Likewise, if they consider that the processing of their personal data violates the regulations, they have the right to file a claim with the Spanish Data Protection Agency (www.aepd.es) or with the competent control authority.
11.6 Security measures
Adaptative has adopted the necessary technical and organizational measures to guarantee the security of personal data, avoiding its alteration, loss, processing, or unauthorized access, taking into account the state of technology, the costs of application, and the nature, scope, context, and purposes of processing.
These measures include:
- Encryption of data in transit and at rest.
- Role-based access controls.
- Regular backups.
- Regular security updates.
- Security audits.
- Continuous staff training on data protection.
- Security incident response plan.
Adaptative will notify the User and the competent control authority of personal data security breaches in accordance with the provisions of current regulations.
11.7 Privacy by design and by default
Adaptative applies the principles of privacy by design and privacy by default in all its processes and services, implementing appropriate technical and organizational measures both at the time of determining the means of processing and at the time of processing itself.
11.8 Impact assessment
For those treatments that may pose a high risk to the rights and freedoms of Users, Adaptative has carried out the corresponding data protection impact assessments, adopting the necessary measures to mitigate these risks.
12. COOKIES AND SIMILAR TECHNOLOGIES
Snackson uses cookies and similar technologies to improve the User experience, analyze the use of the platform, and personalize content. The User can configure their browser to block or alert about these cookies, but some parts of the platform may not function correctly.
In the mobile application, device identifiers and other technologies are used for similar purposes. The User can consult the complete cookie policy at https://en.snackson.com/cookies-en
13. JURISDICTION AND APPLICABLE LEGISLATION
The compliance and interpretation of these Terms of Use will be carried out in accordance with the provisions of Spanish and European Union regulations. In case of any conflict in relation to these terms and conditions of use, the parties submit, with express waiver of any other jurisdiction, to the Courts of Barcelona, unless the applicable regulations imperatively determine another jurisdiction.
The parties commit to resolve in a friendly manner any disagreement that may arise in the development of the activity. In case it is not possible to find an amicable solution, and it is necessary to resort to judicial means for the resolution of disputes, the jurisdiction corresponding to the user will be competent.
